These Terms & Conditions ("Terms") govern everything offered by Swimpros GmbH ("Swimpros", "we", "us"), a limited liability company incorporated in Switzerland, with its registered office at Bändlistrasse 54, 8064 Zürich, Switzerland.
Swimpros GmbH is entered in the Commercial Register of the Canton of Zürich under company number (UID) CHE-281.770.574. You can check our entry in the official Swiss register at any time. Full company details are on our Impressum. You can reach us any time at [email protected].
By booking a place, paying a deposit, joining one of our online programmes, buying our kit, or attending a Swimpros camp or event, you (the "participant", or the parent/guardian booking on a minor's behalf) agree to these Terms.
We sell three things, and these Terms cover all of them:
Where a section below applies to only one of these, it says so.
What each camp includes is described on the relevant camp page at the time of booking. A residential place typically includes coaching, training, accommodation, meals and airport transfer. A non-residential place includes coaching and training only, and the participant stays with their own family.
Flights and travel to and from the venue are never included unless we state so in writing. Anything not listed as included is the participant's own responsibility.
For residential places we arrange the accommodation, the meals and the airport transfer at the camp location, and we are the organiser of those arrangements. We select and work with reputable local venues and providers.
We are not a flight agent and we do not sell, book or arrange your flights. You book your own travel to and from the camp, which is why the book-your-flights week in Section 3 exists.
Payments are processed by our third-party payment provider (Stripe). We do not store your full card details. You confirm you are authorised to use the payment method provided.
If we change or cancel a camp: we may change the dates, venue, coaches, schedule or programme where reasonably necessary. If we make a significant change or cancel a camp entirely (and not because of your conduct or a force-majeure event under Section 13), you may choose either a transfer to another camp or a refund of the amounts you have paid for that camp. That is the limit of our responsibility for such changes.
If the participant is under 18, a parent or legal guardian must make the booking, agree to these Terms, and provide accurate emergency-contact and medical information. The parent/guardian grants the consents in these Terms (including Section 10) on the participant's behalf.
We take photos and videos during camps, both for our records and to show what we do on our website, in our social media and in our community. By attending, you consent to Swimpros using such images and footage.
If you do not want a participant's image used, tell us in writing at [email protected] before the camp and we will respect it. You can also withdraw that consent later at any time: write to the same address, tell us what you want taken down, and we will remove it from anything we control.
Alongside camps we offer digital coaching products: online programmes, courses, memberships and access to our community.
Where we supply Swimpros-branded clothing or equipment, sizes and print names are taken from what you give us, so please check them before you confirm. Items personalised with a name cannot be returned unless they are faulty. For anything else, tell us within 14 days of receiving it and we will arrange a return or replacement. Faulty goods are always put right.
We are not responsible for failure or delay caused by events beyond our reasonable control (for example extreme weather, natural disaster, epidemic or pandemic, war, strike, or venue closure). In such cases we will offer a transfer to a future camp or a credit where reasonably possible.
To the fullest extent permitted by Swiss law: we are liable only for damage we cause through our intent or gross negligence, and liability for slight negligence is excluded. We are not liable for indirect or consequential loss, for lost, stolen or damaged personal belongings, or for the acts of third parties (including the venue, transport providers, the payment provider or the community platform). Nothing in these Terms excludes or limits liability where it cannot be excluded under mandatory Swiss law, including for death or personal injury caused by our intent or gross negligence.
We handle personal data in line with the Swiss Federal Act on Data Protection (FADP) and, where it applies, the EU GDPR. We collect the information needed to run the camp and our programmes (contact, swimmer and health details, and payment records) and use it only for that purpose and related communication. We may update these Terms from time to time. The version that applies to your booking is the one published here at the time you book.
If something is wrong, tell us first and give us the chance to fix it. Write to [email protected] with what happened and what you would like done. We answer every complaint, and we would far rather sort it out directly than have you take it anywhere else.
These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for any dispute is the courts of Zürich, Switzerland, subject to any mandatory place of jurisdiction for consumers under Swiss law.
